l Attorney General Memorandum  MR/RC providers seeking to negotiate new contract payment rates with counties after their clients experience changes in their Individual Service Plans should review the February 18, 2005, Legal Memorandum from the Office of the Attorney General to DHS. This Memorandum, which provides information regarding the obligations and responsibilities of counties during recipient appeals, was attained by Orbovich & Gartner's client ARRM as part of the negotiated settlement of a major federal lawsuit challenging the State's re-basing of allocations under the Home and Community Based Waivered Service Program for Persons with Developmental Disabilities.
